إقرار بالعلم والموافقة على استخدام الموقع ونشر الإعلانات

أعلم أن هذا الموقع مخصص لعرض وطلب وبيع وشراء قطع غيار السيارات المستعملة أو الجديدة أو المجددة أو التالفة أو المصلحة، وأن الإعلانات المنشورة في الموقع يتم إدخالها ونشرها من قبل المستخدمين أو المعلنين، وأن الموقع يعمل كمنصة إعلانية ووسيط تقني فقط، ولا يُعد بائعاً أو مالكاً أو مورداً أو ضامناً للقطع المعروضة من قبل المستخدمين، ما لم يُذكر خلاف ذلك صراحةً في إعلان رسمي صادر من إدارة الموقع.

1. مسؤولية المستخدم والمعلن

أقر وأتعهد بأنني المسؤول وحدي مسؤولية كاملة عن أي إعلان أو صورة أو وصف أو سعر أو رقم قطعة أو معلومة أو بيانات أقوم بنشرها في الموقع، وأتحمل وحدي جميع النتائج القانونية أو المالية أو المدنية أو الجزائية الناتجة عن أي مخالفة أو خطأ أو تضليل أو غش أو احتيال أو ادعاء غير صحيح.

كما أقر بأن جميع البيانات التي أقدمها صحيحة وحديثة، وأنني أملك الحق القانوني في عرض القطعة أو بيعها أو الإعلان عنها، وأن القطعة غير مسروقة وغير مقلدة وغير محظورة وغير مخالفة للقانون ولا يوجد عليها نزاع أو حق للغير.

2. الالتزام بالقوانين

أتعهد بالالتزام بجميع القوانين واللوائح والقرارات المعمول بها في دولة الكويت، بما في ذلك القوانين المتعلقة بحماية المستهلك، المعاملات الإلكترونية، التجارة الرقمية، مكافحة الغش، العلامات التجارية، حماية البيانات، والجرائم الإلكترونية، وأي قوانين أخرى ذات صلة.

وفي حال استخدام الموقع من خارج دولة الكويت، أقر بأنني ألتزم أيضاً بالقوانين واللوائح المعمول بها في الدولة التي أقيم فيها أو تتم فيها عملية البيع أو الشراء أو الشحن أو التسليم، وأتحمل وحدي مسؤولية التأكد من مشروعية عرض أو بيع أو شراء أو شحن القطعة.

3. حالة القطعة ووصف الإعلان

أتعهد بأن يكون وصف القطعة واضحاً وصادقاً ودقيقاً، وأن أبيّن حالتها الفعلية بقدر علمي، بما في ذلك ما إذا كانت:

  • جديدة
  • مستعملة
  • مجددة
  • مصلحة
  • تالفة
  • مفكوكة من مركبة متضررة
  • أصلية
  • تجارية أو بديلة
  • مقلدة أو غير أصلية، إن كان عرضها مسموحاً قانوناً مع الإفصاح الكامل

كما أتعهد بذكر أي عيب جوهري أو كسر أو تلف أو نقص أو إصلاح سابق أو اختلاف في رقم القطعة أو عدم توافقها مع بعض المركبات متى كان ذلك معلوماً لي.

4. الإعلانات والمحتويات المحظورة

يحظر على المستخدم نشر أو عرض أو بيع أو الترويج لأي مما يلي:

  • القطع المسروقة أو المفقودة أو المشتبه بمصدرها.
  • القطع المقلدة أو المخالفة للعلامات التجارية دون إفصاح واضح أو بما يخالف القانون.
  • القطع المحظور بيعها أو تداولها قانوناً.
  • أي إعلان يتضمن غشاً أو تدليساً أو معلومات مضللة.
  • أي إعلان يستخدم صوراً لا تعود للقطعة المعروضة.
  • أي إعلان يتضمن سعراً وهمياً أو غير حقيقي أو شروطاً مخفية.
  • أي محتوى يخالف الآداب العامة أو النظام العام أو القوانين المعمول بها.
  • أي استخدام لاسم الموقع أو شعاره أو بياناته بطريقة مضللة أو غير مصرح بها.
  • أي محاولة لتحويل الموقع إلى وسيلة احتيال أو تحصيل مبالغ بطرق غير مشروعة.
  • أي محتوى يعتدي على حقوق الملكية الفكرية أو العلامات التجارية أو حقوق الغير.

5. مسؤولية الفحص والمعاينة

أقر بأن فحص القطعة والتأكد من حالتها ومناسبتها للمركبة ورقمها وسعرها وطريقة الدفع والاستلام والشحن والتركيب يقع على مسؤولية البائع والمشتري وحدهما.

وعلى المشتري أن يقوم بالمعاينة والفحص والتحقق من القطعة قبل إتمام الشراء أو الدفع، ولا يعتبر وجود الإعلان في الموقع ضماناً من الموقع لجودة القطعة أو أصالتها أو صلاحيتها أو مطابقتها للوصف.

6. حدود مسؤولية الموقع

أقر بأن الموقع لا يتحمل المسؤولية عن صحة أو دقة أو قانونية الإعلانات المنشورة من المستخدمين، ولا يتحمل المسؤولية عن أي خلاف أو خسارة أو ضرر أو مطالبة أو احتيال أو عيب أو تأخير أو فشل في التسليم أو سوء استخدام ينشأ بين المستخدمين نتيجة إعلان أو تواصل أو بيع أو شراء أو شحن أو تركيب أي قطعة، وذلك كله في حدود ما تجيزه القوانين واللوائح المعمول بها.

ولا يُعد الموقع طرفاً في أي اتفاق أو بيع أو شراء يتم بين المستخدمين، ما لم يتم النص صراحةً وبشكل رسمي على خلاف ذلك.

7. حق الموقع في المراجعة والحذف والإيقاف

يحق لإدارة الموقع، دون الحاجة إلى إشعار مسبق، حذف أو تعديل أو إخفاء أو تعليق أي إعلان، أو إيقاف أو حظر أي حساب، أو طلب مستندات أو معلومات إضافية، متى رأت أو اشتبهت بوجود مخالفة لهذا الإقرار أو شروط الاستخدام أو القوانين المعمول بها، أو عند ورود بلاغ جدي من مستخدم أو جهة مختصة.

كما يحق للموقع الاحتفاظ بسجلات الإعلان وبيانات الحساب والتواصل والبلاغات والموافقات ووقت وتاريخ ووسيلة الدخول، متى كان ذلك لازماً لتشغيل الخدمة أو حماية الحقوق أو التعامل مع الشكاوى أو الامتثال للمتطلبات القانونية.

8. البلاغات والشكاوى

أتعهد بإبلاغ إدارة الموقع فوراً عند الاشتباه بوجود إعلان مخالف أو قطعة مسروقة أو عملية احتيال أو انتحال صفة أو استخدام غير مشروع.

ويحق للموقع اتخاذ الإجراء المناسب حسب تقديره، بما في ذلك إخفاء الإعلان مؤقتاً، طلب إثبات الملكية، إيقاف الحساب، أو إحالة البيانات للجهات المختصة متى تطلب الأمر ذلك أو بناءً على طلب رسمي.

9. البيانات والخصوصية

أوافق على أن يقوم الموقع بجمع وحفظ واستخدام البيانات اللازمة لتشغيل الخدمة، وإدارة الحسابات، ونشر الإعلانات، والتواصل بين المستخدمين، ومعالجة البلاغات والشكاوى، وتحسين الخدمة، والامتثال للقوانين والطلبات الرسمية من الجهات المختصة، وذلك وفقاً لسياسة الخصوصية المعتمدة في الموقع.

10. الموافقة الإلكترونية

أقر بأن الضغط على زر «أوافق» أو «أقرّ وأوافق» أو إنشاء حساب أو نشر إعلان أو الاستمرار في استخدام الموقع يُعد موافقة إلكترونية صريحة وملزمة مني على هذا الإقرار، ويكون لهذه الموافقة أثر قانوني معتبر متى أجاز القانون ذلك.

11. تعديل الإقرار

يحق للموقع تعديل هذا الإقرار أو تحديثه في أي وقت، وتكون النسخة المنشورة في الموقع هي النسخة المعتمدة. ويُعد استمرار المستخدم في استخدام الموقع بعد نشر التعديل قبولاً منه بالنسخة المعدلة.

12. الاختصاص والقانون الواجب التطبيق

يخضع هذا الإقرار ويفسر وفقاً للقوانين المعمول بها في دولة الكويت، وذلك دون الإخلال بأي قواعد آمرة قد تنطبق على المستخدم أو العملية في دولة أخرى عند الاستخدام أو البيع أو الشحن خارج الكويت.

وفي حال نشوء أي نزاع يتعلق باستخدام الموقع، يكون الاختصاص للجهات والمحاكم المختصة في دولة الكويت، ما لم تقرر القوانين الآمرة خلاف ذلك.

  • Genuine
  • Aftermarket or replacement
  • Non-genuine or imitation, if legally permitted and fully disclosed

I also undertake to disclose any material defect, breakage, damage, missing component, previous repair, part number mismatch, or compatibility issue whenever such information is known to me.

4. Prohibited Listings and Content

Users are prohibited from publishing, listing, selling, or promoting any of the following:

  • Stolen, lost, or suspiciously sourced parts.
  • Counterfeit parts or trademark-infringing goods without clear disclosure or in violation of the law.
  • Parts whose sale or circulation is legally prohibited.
  • Any listing involving fraud, deception, or misleading information.
  • Any listing using images that do not belong to the actual listed part.
  • Any listing containing fake prices, hidden conditions, or misleading terms.
  • Any content that violates public morals, public order, or applicable laws.

5. Inspection and Verification Responsibility
